Judge Says Musk Plays Federal Role Without Approval
In a ruling released on Tuesday, U.S. District Judge Tanya Chutkan acknowledged that the states’ lawsuit credibly claims Musk, who heads the Department of Government Efficiency (DOGE), “exercises significant authority” without having secured confirmation from the Senate or formal congressional consent, as reported by a news agency.
Back in February, a coalition of 14 states, led by New Mexico, filed a lawsuit against Elon Musk, DOGE, and Leader Donald Trump, alleging constitutional violations.
The legal teams representing the states contended that Musk did not have the lawful power to enforce substantial reforms in the federal government, since he is not an official confirmed by the Senate, and DOGE itself had never received congressional authorization.
White House lawyers sought to dismiss the lawsuit by characterizing Musk’s involvement in the Trump administration as purely advisory and temporary in nature.
However, in its effort to dismiss the case against Musk, DOGE, and Trump, the White House’s attempt to frame Musk’s role as fleeting was deemed “unsuccessful,” according to Judge Chutkan.
The judge noted that Musk’s influence appears to extend across the entire executive branch without defined boundaries, despite the White House’s effort to minimize his position by labeling him merely an advisor lacking formal authority.
Chutkan further observed that the states’ allegations that DOGE gained “unauthorized access” to “private and proprietary information” sufficiently indicated potential harm, justifying the lawsuit’s continuation.
