Trump's Bid to Push Back Tariff Refunds Blocked by Court

(MENAFN) A US federal court on Monday dealt a sharp blow to the Trump administration, rejecting its attempt to stall the repayment of billions of dollars in tariffs previously ruled unlawful by the US Supreme Court.

The US Court of Appeals for the Federal Circuit moved the refund process forward by transferring the matter to a lower court, dismissing a US Department of Justice request for a 90-day postponement outright.

"Nothing about the refund issue warrants any delay in issuing this Court's mandate, let alone a staggering three months' delay," the court filing said, adding that "the proper time to issue the mandate is now."

Despite the ruling's momentum, US Department of Justice lawyers cautioned that executing the refunds could stretch across several years — a warning that echoes earlier alerts from Trump administration officials who had long flagged the risk of large-scale repayments if the government lost at the Supreme Court level.

That loss materialized on Feb. 20, when the US Supreme Court ruled that the sweeping tariffs President Donald Trump had levied against most countries were unlawful, formally opening the door for importers to pursue reimbursement.

The financial stakes are staggering. By mid-December, the government had already collected upward of $130 billion through the contested tariffs, with total potential refund liability estimated at $175 billion. The US Supreme Court stopped short of providing a repayment framework, leaving the US Court of International Trade to untangle the complex mechanics of how that process will ultimately unfold.
